Right of withdrawal
You have the right to withdraw from the contract with us or another seller on preiswertquartier.de within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of withdrawal, you can - whether you have a contract with us or another seller on preiswertquartier.de - inform us (smakimo GmbH, Lilienthalstraße 146 - Haus 3, 34123 Kassel ) by means of a clear statement (eg a letter sent by mail, fax or e-mail) about your decision to revoke the contract. To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.
Consequences of revocation
If you revoke the contract, all payments made, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered), will be refunded to you immediately and at the latest within fourteen days from the day on which the notification of your revocation of the contract was received. The same means of payment that you used for the original transaction will be used for this repayment, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. The repayment may be refused until the goods have been received back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods to the respective seller immediately and in any case no later than within fourteen days from the day on which you informed about the cancellation of the contract. You shall not bear any costs for the return of the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.
Exclusion/Extinction of the Right of Withdrawal
Pursuant to Section 312g (2) of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or that are clearly tailored to the consumer's personal needs, and it expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
Delivery is only within Germany. We deliver only within the Federal Republic of Germany. Deliveries abroad are unfortunately not possible. Please refer to the respective product description for delivery time. Deliveries to islands will be charged with a surcharge (on request ).
All prices are total prices in euros (€), i.e. they include all price components including the statutory sales tax.

If delivered items show obvious material or manufacturing defects, which also include transport damages, please claim such defects immediately to us or to the employee of the shipping service provider who delivers the items.
For all defects of the purchased goods occurring during the statutory warranty period, the statutory claims for supplementary performance, for defect removal/replacement as well as - if the statutory requirements are met - the further claims for reduction or rescission shall apply at your discretion, as well as for damages, including compensation for the damage instead of performance as well as compensation for your futile expenses.
Payment:
You can pay all sellers in principle by prepayment, credit card, direct debit, on account or by installment. For purchases where we (smakimo) are the only seller, you can also pay via PayPal and paydirekt. The possibility of discount deduction does not exist.
In order to be able to offer you an attractive range of payment methods, we work together with various payment service providers. We reserve the right to offer you only certain payment methods for the requested delivery, for example, to hedge our credit risk only those according to the respective credit rating.
An order is processed only after a deposit in the amount of 25%. Another 65% is to be paid after notification and 10% upon delivery. After receiving the order, we will coordinate this with the customer.
If you are in default with regard to a purchase from us (smakimo GmbH), we reserve the right to charge a flat rate of € 1.25 for each reminder as compensation for the damage incurred; you are free to prove in each case that we have incurred no damage or only a lesser damage. In addition, we may charge you statutory interest on arrears in the amount of five percentage points above the base interest rate.
The Buyer shall be in default of payment even without a reminder if he fails to comply with the aforementioned deadlines.
The conclusion of the contract is subject to suspensive conditions in the event that the credit check carried out by smakimo leads to a negative result with regard to the purchaser.
Retention of title:
Until full payment, the goods remain the property of the respective seller.
